Terms of Use

These Terms of Use govern the use of the Talkard app and the website talkard.app, provided by Pedro Henrique Ferreira da Costa Damião, an individual based in Juiz de Fora (MG), Brazil (“we”). By downloading, installing or using Talkard, you agree to these terms and confirm that you have read our Privacy Policy.

If you do not agree, do not use the app.

Talkard is meant for people aged 13 and over. If you are between 13 and 17, use the app with your parents’ or guardians’ knowledge. Purchases must be made or approved by them.

Talkard is a flashcard app for learning languages. You create decks and cards in six languages (Portuguese, English, Spanish, French, German and Italian), with example sentences, and study by answering out loud or by typing, with spaced repetition.

The app works without an account and without a server of its own. Some features depend on your phone and on third parties, such as the system speech recognition and text to speech, and the app store.

We grant you a personal, non-exclusive, non-transferable and revocable license to use Talkard on devices you control, for personal and non-commercial purposes, under these terms and the rules of the store you downloaded the app from. You may not:

• copy, modify, decompile or reverse engineer the app, except where the law allows it;
• get around the Free plan limits, the subscription mechanisms or the security measures;
• resell, rent, sublicense or distribute the app or parts of it;
• use the app for illegal purposes or to infringe the rights of others.

The decks, cards and sentences you add are yours, and you are responsible for them. By adding content, you confirm that you have the right to use it.

This content stays on your phone only: we have no access to it, we do not review it and we do not use it for any purpose.

Since we have no server and no copy of your data, you are responsible for making backups in the app itself, under Settings › Your data. We cannot recover data lost through uninstalling, clearing the app’s data, or a device being replaced, lost, stolen or broken.

The Free plan allows 1 deck and up to 50 cards per deck, with every study feature. The Pro plan unlocks unlimited decks and cards.

• Price and billing: Pro is a monthly or yearly subscription, purchased and billed through Google Play. The price, taxes and currency are shown in the store before you buy and may vary by country.
• Automatic renewal: the subscription renews at the end of each period and is charged to the payment method on your Google account until you cancel.
• Free trial: if the store offers a trial period, billing starts automatically when it ends unless you cancel before then. The trial is available once per account, under the store’s rules.
• Cancellation: cancel anytime in Google Play › Payments & subscriptions, or with “Manage subscription” on the Plans screen of the app. Pro stays active until the end of the period already paid. Uninstalling the app does not cancel the subscription.
• Price changes: if the price changes, Google Play lets you know in advance, under its rules, and you can cancel before the new charge.
• Restoring: Pro can be restored on another Android device with the same Google account, with the “Restore purchases” button.
• When the subscription ends: your oldest deck stays unlocked and the others are locked. In a locked deck you can view the cards and delete the deck, but you cannot study, add, edit or rename. If the unlocked deck has more than 50 cards, you can study it and delete cards; editing comes back at 50 cards or fewer, and adding below 50. If you delete the unlocked deck, the next oldest one is unlocked. Nothing is deleted: backups still export everything, and subscribing again unlocks all decks. If the app cannot reach the store, for example without internet, the Free plan rules apply 3 days after the end of the paid period.

You can withdraw from the subscription within 7 days of being charged, with a full refund (right of withdrawal under art. 49 of the Brazilian Consumer Protection Code). To do so, request a refund through Google Play or write to hello@talkard.app with your order number (it starts with GPA.).

After that period, refunds follow Google Play’s policy, without prejudice to any other rights granted by law. If you live in another country, you also have the withdrawal rights provided by your local law, under the conditions shown by the store.

Speech recognition and pronunciation use features of your phone’s system. Accuracy may vary with the device, language, accent, background noise and connection, and we do not guarantee that every answer will be recognized correctly. Typing is always available.

We work to keep Talkard running well, but it may have bugs or not work on some devices or system versions. We may release updates that change, improve or remove features. We will not reduce Pro benefits during a period already paid for.

The Talkard name, brand, icon, design, texts and code of the app and the site belong to Pedro Henrique Ferreira da Costa Damião. These terms do not transfer any of these rights to you.

Talkard is a study aid and does not guarantee learning results. To the extent permitted by law, we are not liable for loss of data stored on the device, for failures of the phone’s system or of third-party services, or for use of the app that breaks these terms.

Nothing in these terms limits consumer rights that the law guarantees and that cannot be waived by contract.

You can stop using Talkard whenever you want by uninstalling the app. If you have a subscription, cancel it in the store as well.

We may end your license if these terms are seriously breached, or discontinue the app. In that case we will give reasonable notice whenever possible, and your data stays on your phone.

These terms are governed by the laws of Brazil, including the Consumer Protection Code and the LGPD. The courts of Juiz de Fora (MG) have jurisdiction, without prejudice to your right to bring proceedings in the courts where you live.

If you live outside Brazil, the mandatory consumer protections of your country also apply.

We may update these terms. The date at the top shows the current version. Relevant changes will be announced in the app or on the site before they take effect. If you keep using Talkard after that, you accept the new version.
